Texas’ allotted EduJobs funds delayed but not gone for good

On Sept. 9, The U.S. Department of Education (DOE) denied Texas’ application for $830 million in federal aid through the Education Jobs Fund. The denial was based on a lack of adequate assurance from the Governor for maintenance of effort in state aid to schools for the next three years. Since the denial was issued, the DOE has said that it would hold the funds for Texas until the legislature convenes for the 82nd Session and the application can be resubmitted. The Governor’s Office has since filed a lawsuit against the DOE to secure these funds for Texas.

While negotiations continue, it appears likely that Texas will ultimately receive the $830 million in federal aid. The EduJobs funds must be distributed through federal Title 1 formulas, although the money does not have to be spent on Title 1 programs. The Education Department provides broad latitude to districts on how the money can be spent. The only restrictions are that districts cannot use the money to pay for central office level administrators; outside contractors; fund balances; debt retirement; or general administrative expenses.
